1. Acceptance of Terms

By accessing or using ItsAMatch.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Age Requirement

You must be at least 18 years old to use this Service.

By using ItsAMatch, you represent and warrant that you are 18 years of age or older. We do not knowingly collect or solicit personal information from anyone under 18. If you are under 18, please do not use this Service or provide any information to us.

If we learn that we have collected personal information from a person under 18, we will delete that information as quickly as possible. If you believe we might have any information from or about a person under 18, please contact us immediately.

3. Service Description

ItsAMatch is an AI-powered dating simulation platform that allows users to:

  • Create and manage virtual personas
  • Interact with AI-generated profiles and characters
  • Engage in simulated conversations and romantic scenarios
  • Generate images and content using artificial intelligence

Important Disclaimer: All profiles, conversations, and interactions on ItsAMatch are generated by artificial intelligence and are entirely fictional. No real people are represented by the AI-generated profiles. The Service is intended for entertainment purposes only.

4. User Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law
  • Violate or encourage others to violate the rights of third parties, including intellectual property rights
  • Attempt to gain unauthorized access to the Service, other user accounts, or computer systems
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Upload, post, or transmit any viruses, malware, or other malicious code
  • Harass, abuse, or harm other users or our staff
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use automated systems (bots, scrapers, etc.) to access the Service without our permission

5. Content

User Content

You retain ownership of any content you submit to the Service ("User Content"), including personas, images, and text. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of providing and improving the Service.

AI-Generated Content

All AI-generated profiles, images, and conversations created by the Service are owned by ItsAMatch.ai. You may use AI-generated content within the Service for personal, non-commercial purposes only.

Prohibited Content

You may not upload, post, or request generation of content that:

  • Depicts or promotes illegal activities
  • Contains minors or individuals who appear to be minors
  • Violates intellectual property rights or privacy rights of others
  • Contains malware or other harmful code

6. Subscriptions & Billing

ItsAMatch offers both free and paid subscription plans. Paid subscriptions provide access to additional features including increased AI profile generation limits, enhanced image quality, and priority support.

Billing Cycle

Paid subscriptions are billed on a recurring basis (monthly or annually, depending on the plan you select). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method on file for all recurring subscription fees.

Price Changes

We reserve the right to change subscription pricing at any time. We will provide at least 30 days' advance notice of any price changes by email or through the Service. Continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.

Payment Processing

All payments are processed securely through our third-party payment provider, Stripe. We do not store your full payment card details on our servers. By providing your payment information, you agree to Stripe's terms of service and privacy policy.

Free Tier: The free tier is subject to usage limits that may change at our discretion. We reserve the right to modify free tier limits or discontinue the free tier with reasonable notice.

7. Refund & Cancellation Policy

Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at support@itsamatch.ai. Upon cancellation, your subscription will remain active through the end of the current billing period, after which it will not renew.

Refunds

All subscription fees are non-refundable except as required by applicable law. We do not provide refunds or credits for partial months of service, plan downgrades, or unused features.

We may, at our sole discretion, offer a refund in exceptional circumstances such as documented technical failures on our part that substantially prevented access to the Service. Refund requests must be submitted within 14 days of the charge in question.

EU/UK Consumers: If you are located in the European Union or United Kingdom, you may have a statutory right to a 14-day cooling-off period for digital services. This right may not apply if you have begun using the Service during that period and have expressly waived your right of withdrawal.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not warrant the accuracy, completeness, or usefulness of any AI-generated content. The Service is not a substitute for professional advice or real human relationships.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ITSAMATCH.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party or AI-generated content on the Service
  • Unauthorized access, use, or alteration of your content

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will provide notice through the Service or by email. Your continued use of the Service after such notice constitutes acceptance of the updated Terms.
